摘要 行政奖励,是指行政主体为了实现行政目标,鼓励、倡导行政相对人或行政主体内部工作人员为一定的作为或不作为,并且依照法定条件和程序,对符合条件的行政相对人或内部工作人员给予物质、精神及其他利益的具体行政行为。行政奖励是一种具体行政行为,行政奖励的施行会对行政相对人的权益产生实际影响。按照“有权利必有救济”的法的基本理念,对行政奖励救济作相应的制度安排既是理论所需,又是实践必行。本文采用实证分析、逻辑分析和文献检索的方法,从行政奖励、行政救济等基础范畴入手,分析了行政奖励救济的理论根源和现实必要性,并且对行政奖励违法行为进行了类型化研究,对我国目前行政奖励救济制度存在的问题和缺陷作了粗略的总结和探讨,并在此基础上,对行政奖励救济制度应该采用的救济形式或途径进行了相应的设计。本文共分为三部分: 第一部分:对行政奖励救济的几个基础范畴进行了介绍分析,运用逻辑学的方法对行政奖励的内涵和外延作了界定,并分析了行政奖励与相关概念之间的关系,对行政救济的理论作了必要的介绍,并在此基础上引申出行政奖励救济的概念、特征、分类和形式; 第二部分:从动态意义上分析行政奖励救济制度运行的理论根据,并对可能存在的违法行政奖励行为作类型化研究,为构建行政奖励救济体系奠定坚实的基础,分析了我国行政奖励救济制度的运行现状及存在的缺陷; 第三部分:从静态意义上对行政奖励救济的途径或形式作了相应的制度设计,包括行政奖励听证制度、信访制度、督察专员制度、行政复议制度、行政诉讼和行政赔偿制度等。
外文摘要 Administrative encouragement refers to the administrative specific act, through which the subject encourages its inside personnel as well as the object to act or not for the purpose of realization of certain administrative objectives, and rewards those who are qualified in material, spiritual or other ways, according to lawful conditions and procedure. Administrative encouragement is a kind of specific act, which will make an actual impact on the object’s rights and interests. Therefore in accordance with the basic legal principle of relief accompanying rights, the design of Relieving System of Administrative Encouragement is not only theoretically necessary, but also practically imperative. Starting with the fundamental concepts and searching relevant documents, this dissertation analyses theoretical source and real necessity of Relieving System of Administrative Encouragement logically and empirically, typologically researches into the illegal activities of administrative encouragement, roughly investigates into the problems and defects existing in Relieving System of Administrative Encouragement, and correspondingly designs appropriate forms or ways for Relieving System of Administrative Encouragement. This dissertation is divided into three parts. Part One firstly introduces some fundamental concepts of Relieving System of Administrative Encouragement, then logically defines the connotation and extension of administrative encouragement and analyses the relationship between administrative encouragement and its relevant concepts. In this part, the theory of administrative relief is necessarily introduced, and the concept, characteristics, classification and forms of Relieving System of Administrative Encouragement are naturally elicited. Part Two dynamically analyses the operation rationale of Relieving System of Administrative Encouragement, typologically researches into the possible illegal activities of administrative encouragement to lay a strong foundation for construction of Relieving System of Administrative Encouragement, and it also analyses status quo of operation and defects of Relieving System of Administrative Encouragement in China.
